The marriage registration process of the Civil Affairs Bureau can be divided into three steps: application, examination and registration. Both men and women who are married must carry the documents required for marriage registration to apply for marriage registration at the marriage registration office where one party is registered, and if they have been divorced, they should also hold a divorce certificate. A pre-marital examination certificate from a hospital should also be obtained at the place where the pre-marital examination is carried out.

1. Application

Both men and women who want to get married shall apply for marriage registration at the marriage registration office in the place where one party has his or her household registration certificate, resident identity card and the certificate of his or her birth date, nationality and marital status issued by the work unit or production brigade. Both men and women must be present at the time of application for registration, and if they have been divorced, they should also have a divorce certificate. A pre-marital examination certificate from a hospital should also be obtained at the place where the pre-marital examination is carried out.

1. Chinese citizens apply for marriage in China

Both parties must apply for marriage registration in person at the marriage registration office where one party's household registration is located. When applying, the following documents and certificates shall be presented:

(1) Household registration certificate;

(2) resident identity card;

Those who have been divorced shall also hold a divorce certificate. If the parties to the divorce resume the husband-wife relationship, both parties must apply for remarriage registration in person at the marriage registration office in the place where one party has his or her household registration.

(2) Chinese citizens and foreigners (including resident and temporary foreigners in China, foreign Chinese and foreign nationals residing in China) apply for marriage in China

Both parties must jointly apply for marriage registration at the marriage registration office designated by the people's government of the province, autonomous region or municipality directly under the Central Government where the registered residence of a Chinese citizen is located. Chinese citizens and foreigners applying for registration must hold the following documents respectively:

Chinese citizens must hold:

(1) my household registration certificate;

(2) The certificate of my name, gender, date of birth, nationality, marital status (unmarried, divorced, widowed), occupation, nature of work and who to apply for marriage issued by the people's government at the county level or the organ, school, institution or enterprise at the county level or above where I work.

Foreigners must hold:

(1) Passport or other identity or nationality documents;

(2) The Foreigner's Residence Permit issued by the public security organ, or the identity certificate issued by the foreign affairs department, or the temporary entry or residence permit to China;

(3) The certificate of marital status issued by the notary public of the country certified by the Ministry of Foreign Affairs of the country (or the organ authorized by the Ministry of Foreign Affairs) and the Chinese embassy or consulate in the country, or the certificate of marital status issued by the embassy or consulate in China of the country.

Foreign nationals are required to hold:

(1) Personal passport or identity and nationality documents in lieu of passports (stateless persons are exempt);

(2) Foreigner's Residence Permit issued by the public security organ;

(3) The certificate of my name, gender, date of birth, nationality, marital status (unmarried, divorced, widowed), occupation, nature of work and who to apply for marriage issued by the people's government at the county level or the organ, school, institution or enterprise at the county level or above where I work.

Chinese citizens and foreigners who have complete documents and comply with the provisions of the law may submit an application to the marriage registration office with the certificates and photos of both the man and the woman.

The parties applying for marriage registration shall truthfully provide the relevant certificates and certificates prescribed by the marriage registration authority and shall not conceal the true situation.

Ii. Review

The marriage registration administration organ shall review the application of the parties to find out whether the application for marriage meets the conditions for marriage, and shall inquire of the parties if it is unclear, and when necessary, may require the parties to provide relevant certification materials, or conduct necessary investigations, or designate projects for medical identification.

(3) Registration

The marriage registration authority shall register both parties who meet the marriage registration requirements; If the marriage registration authority refuses to register a party's application for marriage registration, it shall give reasons in writing.

1. Be registered

The marriage registration authority shall immediately register and issue marriage certificates to those who meet the conditions for marriage. For those who have divorced, their divorce certificates shall be cancelled. However, for Chinese citizens and foreigners applying for registration, the registration formalities shall be completed within one month after receiving the application and the marriage certificate shall be issued. The marriage certificate of foreign-related marriage shall be affixed with the photos of both parties, and affixed with the special seal for marriage registration of the people's government at or above the county level for foreign-related marriage registration.

If the parties applying for marriage registration are not able to obtain the required certificates due to the interference of the unit or others, the marriage registration administration authority shall register them if it ascertains that they really meet the conditions for marriage.

2. No registration

The marriage registration authority shall not register the applicant under any of the following circumstances:

(1) those who have not reached the legal age for marriage;

(2) involuntary;

(3) there is a spouse;

(4) Belonging to a direct relative or a collateral relative within three generations;

(5) suffering from a medical condition that does not warrant marriage.

If the marriage registration authority refuses to register a party's application for marriage registration, it shall give reasons in writing. If a party considers that the marriage registration conditions are met but the marriage registration authority does not register, it may apply for reconsideration in accordance with the provisions of the Administrative Reconsideration Law, and if it refuses to accept the reconsideration, it may institute an administrative lawsuit in accordance with the provisions of the Administrative Procedure Law.
