2, no clear agreement, no evidence
If the two parties do not clearly agree that the three gold is given for the purpose of marriage, and there is no evidence that it belongs to the conditions stipulated in the law on bride price, it does not belong to the bride price.

The provisions on bride price in the Marriage Law of the People's Republic of China
Article 10 of the "Judicial Interpretation of Several Issues in the Marriage Law of the People's Republic of China" stipulates that "if the parties request the return of the dowry paid in accordance with custom, the people's court shall support it if the following circumstances are identified: (1) the two parties have not gone through the marriage registration formalities; (2) Both parties have gone through the marriage registration procedures but do not live together; (3) Payment made before marriage and causing hardship to the payer.
