According to relevant laws and regulations in our country, Chinese citizens who marry in foreign countries in accordance with local laws, as long as they do not violate the basic principles of China's Marriage Law and the public interest of the People's Republic of China, their marriage relationship is valid within China.
1、 Legal Basis
Article 147 of the General Principles of the Civil Law of the People's Republic of China stipulates that marriage between citizens of the People's Republic of China and foreigners shall be governed by the law of the place where the marriage was concluded, and divorce shall be governed by the law of the place where the court that accepted the case is located.
2、 Marriage certificates obtained abroad do not require authentication conditions
According to the relevant provisions of the reply from the General Office of the Ministry of Civil Affairs of China on the authentication of overseas marriage certificates for Chinese citizens, citizens (excluding overseas Chinese) who marry abroad should generally register their marriage at the Chinese embassy or consulate in that country (except for those not recognized by their country of residence).
If the country has no diplomatic relations with China or does not recognize the registration of marriage by Chinese embassies or consulates abroad, and the parties marry in accordance with the laws of the place of marriage in that country, as long as it does not violate the basic principles of the Marriage Law of the People's Republic of China and the public interest of the People's Republic of China, their marriage relationship is valid within the territory of China.
Any marriage relationship concluded in a foreign country that is recognized as valid by the above provisions does not require marriage registration or recognition procedures within China. The marriage certificate obtained in accordance with the laws of the place where the marriage was concluded and used within the territory of China shall be notarized and authenticated by the Ministry of Foreign Affairs or an authorized agency of the Ministry of Foreign Affairs of that country, and authenticated by the Chinese Embassy or Consulate in that country.
